Tax Planning and Compliance for Tax-Exempt Organizations, 2005 Supplement
The 2005 supplement includes the following updates: Legislative proposals and a new chief at the helm of the IRS Exempt Organization (EO) Division signal serious change in the regulation and oversight of tax-exempt organizations in the future. The four key initiatives the division will focus on during its 2005 fiscal year include credit counseling, antiterrorism, excess compensation, and abusive schemes. Details of the plans for fiscal 2005 are set out in the IRS Exempt Organizations Implementing Guidelines issued November 2, 2004. New Form 1023 has also been significantly redesigned. The good, challenging, and missing aspects of the format are presented in new Chapter 18.1A. Proposals to enhance governance of tax-exempt organizations have come from several sources this year: the IRS s compliance studies, state attorney generals and legislatures, and the Senate Finance Committee.

The 2005 Cumulative supplement includes the following: Form 990-PF (2004 version), filled in to illustrate reporting issues, is included in Chapter 12 to encourage careful consideration of its preparation. Revised application for recognition of exemption (Form 1023) is included in Chapter 2 along with some details about preparation of the form and some traps inherent therein. Application of the self-dealing rules in general, the personal services exception, the exception for incidental benefits, and foundation-funded disaster relief programs are also discussed.



Form W-2 - Form W-2 is used in the United States income tax system to report wages paid to employees and the taxes withheld from them. The form is also used to report FICA taxes to the Social Security Administration.

Form 1099 - Form 1099 is used in the United States income tax system to report various types of income other than wages, salaries, and tips (Form W-2 is used for those types). Each payer must complete a 1099 for each and every transaction.

Form W-8BEN - The W-8BEN form (entitled Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding) is used in the United States taxation system by foreign individuals to certify their non-American status. The form, issued by the Internal Revenue Service, establishes that one is a foreign, non-resident alien or foreign national performing work outside the United States, in order to claim tax treaty benefits such as a lower amount of tax withholding from dividends paid by U.
